# 1. ACCEPTANCE OF TERMS
By downloading, installing, accessing, or using the **Mero Nepal** mobile application (the “App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App.
# 2. DESCRIPTION OF SERVICE
**Mero Nepal** is a mobile application that provides:
– Hindu calendar (Bikram Sambat and Gregorian)
– Astrological calculations (Kundali, Rashifal/Horoscope)
– Panchanga information (Tithi, Nakshatra, Yoga, Karana)
– Auspicious timing calculations (Rahu Kaal, Bar Bela, Yamghanti, etc.)
– Festival and event information
– Location-based astronomical calculations
The App also provides Money Manager, a personal finance tracker for recording your own income, expenses, transfers, accounts and budgets.
# 3. USER ACCOUNT
## 3.1 Account Creation
– You may be required to create an account to access certain features
– You are responsible for maintaining the confidentiality of your account credentials
– You must provide accurate and complete information when creating an account
– You must be at least 13 years old to use the App
– If you are under the age of majority in Nepal, you may use the App only with the involvement of a parent or guardian
## 3.2 Account Security
– You are responsible for all activities that occur under your account
– Notify us immediately of any unauthorized use of your account
– We are not liable for any loss or damage arising from unauthorized access
# 4. USE OF THE APP
## 4.1 Permitted Use
– You may use the App for personal, non-commercial purposes
– You must comply with all applicable laws and regulations
– You must not use the App for any illegal or unauthorized purpose
## 4.2 Prohibited Activities
You agree NOT to:
– Reverse engineer, decompile, or disassemble the App
– Remove or alter any copyright, trademark, or proprietary notices
– Use the App to transmit any malicious code or harmful content
– Interfere with or disrupt the App’s functionality
– Use automated systems to access the App without permission
– Share your account credentials with others
# 5. INTELLECTUAL PROPERTY
– All content, features, and functionality of the App are owned by **Mero Nepal**
– The App’s design, logos, and graphics are protected by copyright and trademark laws
– You may not copy, modify, distribute, or create derivative works based on the App without written permission
# 6. ACCURACY OF INFORMATION
– We strive to provide accurate astrological and calendar calculations
– However, astronomical calculations may vary slightly based on location and calculation methods
– The App is provided “as is” without warranties of any kind
– We do not guarantee the accuracy, completeness, or reliability of any information provided
# 7. MONEY MANAGER — NOT FINANCIAL ADVICE
Money Manager is a self-entry record-keeping tool. It does not connect to any bank and does not provide financial, investment, tax or accounting advice. All figures, totals, budgets and charts are derived solely from the data you enter, and you are responsible for its accuracy. Always keep your own independent records; do not rely on the App as your only copy.
# 8. SUBSCRIPTION AND PAYMENTS
## 8.1 In-App Purchases
– Certain features may require a paid subscription
– Subscriptions are managed through Apple App Store or Google Play Store
– Payment terms are governed by the respective app store policies
## 8.2 Cancellation and Refunds
– Subscriptions can be cancelled through your app store account settings
– Refund policies are subject to the terms of Apple App Store or Google Play Store
– We do not process refunds directly
Points used for AI features: if an AI request fails and no answer is delivered to you, the points used for that request are returned to your balance. Once an answer has been delivered, the points spent on it are used and are not refundable. Cancelling a subscription does not refund points already spent.
## 8.3 Horoscope Points and QA Points
Horoscope Points and QA Points are a virtual in-app allowance, not currency. Points have no cash value and cannot be exchanged, transferred, or refunded for money, except that points spent on an AI request that fails to deliver an answer are returned to your points balance as described in section 8.2.
# 9. LOCATION DATA
– The App collects location information to provide accurate calculations
– Location data is used solely for calculation purposes
– You can change your location settings at any time within the App
– See our Privacy Policy for details on how location data is handled
# 10. USER-GENERATED CONTENT
– You retain ownership of any content you create (e.g., Kundali data)
– By using the App, you grant us a license to store and process your content to provide our services
– You are responsible for ensuring your content does not violate any laws or third-party rights
# 11. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
– Warranties of merchantability
– Fitness for a particular purpose
– Non-infringement
– Accuracy or reliability of calculations or information
# 12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, **MERO NEPAL** SHALL NOT BE LIABLE FOR:
– Any indirect, incidental, special, consequential, or punitive damages
– Loss of profits, data, or other intangible losses
– Damages resulting from use or inability to use the App
– Any errors or omissions in the App’s content or calculations
# 13. INDEMNIFICATION
You agree to indemnify and hold **Mero Nepal** harmless from any claims, damages, losses, or expenses arising from:
– Your use or misuse of the App
– Your violation of these Terms
– Your violation of any third-party rights
# 14. MODIFICATIONS TO TERMS
– We reserve the right to modify these Terms at any time
– Material changes will be notified through the App or via email
– Continued use of the App after changes constitutes acceptance of the modified Terms
# 15. TERMINATION
– We may terminate or suspend your access to the App at any time, with or without cause
– You may delete your account at any time through the App settings
– Upon termination, your right to use the App will cease immediately
# 16. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.
# 17. DISPUTE RESOLUTION
Any disputes arising from these Terms or the use of the App shall be resolved through:
– Good faith negotiations
– Mediation if negotiations fail
– Applicable courts in Nepal
# 18. ACCOUNT DELETION
## 18.1 30-Day Grace Period
– You may request account deletion through the App settings at any time
– When you request deletion, your account will be scheduled for deletion after a **30-day grace period**
– During the **30-day grace period**, you can cancel the deletion by logging into your account again
– After **30 days** without login, your account and all associated data will be permanently deleted
## 18.2 Subscription During Deletion Period
– If you have an active subscription at the time of deletion request, it will continue until the end of the current billing period
– Subscription will not be automatically renewed after the deletion period
– No refunds will be provided for the remaining subscription period during the grace period
– You can cancel your subscription separately through your app store account settings
# 19. CHAT FEATURE TERMS
## 19.1 Support Chat
– The App provides a Support Chat feature for customer assistance
– Chat messages are monitored and may be reviewed for quality assurance and support purposes
– You are responsible for the content of your chat messages
– Abusive, harassing, or inappropriate language may result in account suspension
– Chat conversations are stored securely and are subject to our Privacy Policy
## 19.2 AI-Powered Responses
– The App may use AI services to provide automated responses in chat
– AI responses are provided “as is” without guarantees of accuracy or appropriateness
– We are not liable for any consequences arising from AI-generated chat responses
– Human support agents may review or override AI responses when necessary
